Taiwan Enacts Tech-Driven Laws Imposing Jail for Breaches of Patient Privacy

Taiwan’s Legislative Yuan has enacted significant amendments to the Medical Care Act, imposing stricter penalties on medical personnel who breach patient privacy. The revised law targets unauthorized actions, such as photographing, filming, or recording patients’ intimate body parts or medical records, introducing a prison sentence of up to three years and fines reaching NT$300,000. Additionally, any equipment utilized in these unauthorized recordings may be subject to confiscation.

These legislative changes come in response to several incidents where clinics were accused of recording patients’ intimate body parts without their consent. The amendments are intended to deter such violations and reinforce the importance of safeguarding patient privacy within medical settings.

Furthermore, the amendments extend penalties to individuals who provide equipment or assistance for these recordings with the intent to profit. Such individuals may face imprisonment of up to five years and fines of up to NT$500,000, reflecting the legislation’s broader scope in addressing privacy violations in healthcare environments.

Beyond privacy concerns, the legislation also intensifies penalties for acts of violence, coercion, or threats directed at medical personnel. This aspect of the law aims to create a safer and more secure working environment for healthcare providers, ensuring they can perform their duties without fear of intimidation or harm.
